Donna Arthur, the birth mother of Ohio gubernatorial candidate Amy Acton, stayed married to Acton’s stepfather, Cledith Arthur, until 2004, even though he had been charged with raping Acton at age 12.
Because Cledith and Donna Arthur fled the state before a trial could take place, Cledith Arthur never faced the rape charges in court prior to his death in 2004. In the absence of a legal conviction, a definitive confirmation of the rape cannot be established.
In October, leading up to the 2026 U.S. midterm elections, Ohio Republican gubernatorial candidate Vivek Ramaswamy published an ad featuring
Acton’s campaign countered by publishing a statement from her brother,
Acton, a former director of the state health department, has publicly discussed her challenging upbringing on multiple occasions. A 1999 profile published by Youngstown newspaper The Vindicator portrayed her early life as marked by abuse, abandonment, and instability, noting she lived in roughly 18 different locations during her first 12 years—including a winter spent residing in a tent at a local campground. That same report touched upon the abuse she endured from her stepfather.
While the pro-Ramaswamy advertisement directly challenged Acton’s account of living in a tent, it omitted the allegations of abuse. However, PolitiFact noted that Donna Arthur previously denied the rape allegations during a 2020 interview with Operation Rescue, an anti-abortion advocacy organization.
Ramaswamy has defended the broadcast, and figures like Donald Trump and JD Vance have voiced their backing for it. During a political rally, Vance advised Republicans to “stop whining” about the controversy surrounding the spot.
Nevertheless, the implication that Acton fabricated her abusive childhood drew criticism for its insensitivity, including from members of the Republican Party. Ohio Senator Jon Husted stated he would not have aired the commercial, while term-limited incumbent Governor Mike DeWine urged Ramaswamy to pull it off the air.
In response to inquiries from readers wanting to verify the truth behind the conflicting claims, an investigation was conducted.
Public legal records substantiate that
When contacted, Acton’s campaign supplied a detailed timeline alongside court files illustrating the rape charges brought against Cledith Arthur, as well as transcripts of Acton addressing her youth. The campaign also pointed out that Donna Arthur was convicted of felony theft in 1996 and animal neglect in 2021. They additionally claimed Cledith Arthur faced an incest charge in 1974 prior to his marriage to Donna, though archival checks clarified he was merely accused rather than formally indicted at that time, as noted in a March 22, 1974 edition of The Youngstown Vindicator.
To verify the materials provided by the campaign, files concerning the criminal case were requested and reviewed through the Mahoning County Clerk in Ohio (available for review here).
Historical newspaper archives were also consulted, uncovering two short reports from The Vindicator published in 1978 that covered the initial rape allegations.
Background searches on both Cledith and Donna Arthur confirmed they shared identical mailing addresses as late as 2003, and public databases yielded no records of a legal separation or divorce.
Ultimately, the verified records aligned completely with Acton’s version of events.
Because Acton was a minor when the events occurred, her name was obscured in the public records obtained through official channels. Conversely, the documents supplied directly by her campaign were unredacted, suggesting that individuals directly involved in the case—such as Acton or her brother—had requested them.
Although a grand jury formally indicted Arthur on the rape charges—to which he entered a plea of not guilty according to court documents—he was never brought to trial because he and Donna Arthur left Ohio before legal proceedings concluded. Cledith Arthur ultimately passed away in Pennsylvania in 2004, per documentation from FindAGrave and campaign records.
The Timeline
A 2019 Vindicator piece noted that Acton’s biological parents,
On July 13, 1978, Acton’s biological father filed an official complaint asserting that Arthur had assaulted Acton between December 1976 and April 1978, while she was between 10 and 12 years old.
Court paperwork listed Arthur’s residence at the time as “Terrace Lake Park” along State Route 7 in Rogers, Ohio, a location now recognized as Terrace Lakes Camp Ground.
Arthur was taken into custody the day after the complaint was filed and entered a not-guilty plea five days later, a development covered by The Vindicator on July 17. Acton and several law enforcement officials were subsequently issued subpoenas to testify.
On August 11, local reporting indicated Arthur would face a grand jury, where he testified and received an indictment in late September 1978.
“In the courthouse after they were charged, I went to give her a kiss, and she just turned her cheek away,”
The couple apparently left the area prior to an October 13 hearing, prompting a judge to issue an arrest warrant for Arthur on October 26. The order stated, “It appears the Defendant has willfully vacated his last known address and has failed to provide any forwarding address and his present whereabouts are unknown.”
An additional warrant followed on December 9, 1981, but Arthur was never located.
