Concerns have been raised about whether contractors and subcontractors involved in the construction of Barack Obama’s presidential library in Chicago have been paid for their work.

While some subcontractors have reported that they have not received payment, the Obama Foundation stated that the project’s construction manager, Lakeside Alliance, holds the primary responsibility for hiring and managing these subcontractors. The foundation further clarified that it has no outstanding disputed charges with Lakeside Alliance and no direct contractual agreements with the subcontractors themselves.

The Obama Presidential Center, a 19.3-acre campus dedicated to preserving the legacy of former President Barack Obama and former First Lady Michelle Obama, officially opened on June 19th. Located in Chicago’s Jackson Park, the center features a museum, community athletic and event spaces, and a Chicago Public Library branch. The project’s estimated cost was $850 million, a figure that has significantly increased from earlier projections.

Reports surfaced from various news outlets, including Crain’s Chicago Business, detailing allegations from subcontractors who claimed they were not paid. These reports suggested that a portion of the project’s cost overruns had been passed on to smaller contractors, some of whom are minority-owned businesses, potentially jeopardizing their operations. These contractors described a complex and delayed construction process with frequent changes to the scope of work and a lack of clarity regarding decision-making authority.

The president of the African American Contractors Association in Chicago reported that several subcontractors had sought his assistance in obtaining payment, with some invoices reportedly totaling tens of millions of dollars. This comes despite the Obama Foundation’s initial commitment to prioritize minority-owned firms for at least 50% of subcontracts.

In response, the Obama Foundation reiterated that Lakeside Alliance, as the construction manager, was responsible for hiring and managing subcontractors. The foundation emphasized its lack of direct contracts with these firms and highlighted its efforts to assist subcontractors through Lakeside Alliance, including measures like accelerated payments.

Lakeside Alliance acknowledged the inherent demands of large-scale construction projects and stated that contractual closeout processes, including the resolution of outstanding invoices, often extend beyond the opening of a facility. They affirmed their commitment to working with the businesses involved to resolve outstanding matters.

Legal experts in construction law have confirmed that the payment structure, where the owner pays the general contractor who then pays subcontractors, is a common industry practice. However, some subcontractors’ representatives believe the ultimate responsibility rests with the project owner to ensure all parties are compensated.

Specific disputes have emerged, including a plumbing contractor claiming millions in unpaid work due to delays and change orders, and a significant lawsuit filed by concrete companies alleging racial discrimination and seeking substantial compensation. Additionally, reports indicate that two minority-owned subcontractors have filed for bankruptcy, citing project delays and financial issues.

Several companies have also filed mechanic’s liens against the Obama Center property, a legal measure to secure payment for unpaid work. While the Obama Foundation maintains its payments to Lakeside Alliance and its lack of direct subcontractor agreements, ongoing disputes among various parties persist. Lakeside Alliance expressed appreciation for the contributions of all those involved in bringing the project to fruition.
